Terms of Use
CarrierCaddy is a personal organizer for your own work. It is not a delivery system, it is not a navigation app, and it is not the authority for a delivery decision. Never use it while driving.
1. Who we are and this agreement
These terms are an agreement between you and Function Desk LLC, a Florida limited liability company (“we”, “us”), the maker of CarrierCaddy. They cover the CarrierCaddy apps for Android and iPhone, the CarrierCaddy service those apps use, and carriercaddy.com. The apps are offered only in the United States.
By installing or using CarrierCaddy, you agree to these terms and acknowledge our Privacy Policy. If you do not agree, do not use it. You must be at least 18 years old, or the age of majority where you live, and able to make a binding agreement. If you use CarrierCaddy for work, you agree for yourself; your employer is not a party to these terms.
Privacy Policy →2. What CarrierCaddy is
A personal organizer for your own work: a place to keep your route, the standing instructions on it, your notes and your daily numbers. It runs on your device.
It is not a delivery system. It does not connect to any employer’s systems, scanners, handheld devices or delivery databases, and it receives no data from them.
It is not a navigation app. It can show where you are on a map and remind you of the next stop, but it does not give turn-by-turn directions. When you ask for directions, they open in the navigation app you choose on your phone.
3. Independent
CarrierCaddy is an independent product of Function Desk LLC. It is not affiliated with, endorsed by, sponsored by or approved by any postal operator, delivery company or employer, and it connects to none of their systems.
4. Your responsibilities and acceptable use
You agree that:
- You will comply with your employer’s policies, your terms of employment, and applicable law in deciding what to enter into the app and what to do with it.
- You are responsible for the information you enter and share, and for having the right to use it.
- You will not make any list of customer names or addresses available to the public by any means. Sharing route data is for people who need it to do the same work, such as a substitute or a colleague covering your route.
- You will only photograph documents and items where you are permitted to do so.
- You will not use the app to harass, surveil or profile anyone.
- You will not misuse the service: no automated or bulk requests, no creating identities to get around allowances, no attempts to probe, overload or defeat its security, and no use of its answers to build a separate database or service.
We may limit, suspend or block a phone’s access to the service if it breaks these rules or threatens the service, its costs or other people who use it. The features that work on the phone alone keep working.
5. Verify against official records
CarrierCaddy is an aid to memory. Holds, forwards, do-not-deliver instructions, addresses and stop positions must be verified against your employer’s records and the item in your hand. Do not rely on the app as the authority for a delivery decision.
6. Driving and safe use
Do not use CarrierCaddy while driving. Keep your eyes on the road and your hands on the controls whenever the vehicle is moving. Look at, tap or type into the app only when the vehicle is stopped in a safe and lawful place.
While you drive, the app is passive. It can show your position on the map and speak a short reminder as a stop comes up, so that you do not need to look at it. Storing, finding and changing information — notes, holds, scans, photos, route edits — is for when you are stopped.
- Traffic laws, road conditions, signs and your own judgment always come first. Follow the law on hand-held and hands-free phone use wherever you drive.
- Mount the phone where it does not block your view, and set up what you need before you move.
- Positions, paths and reminders can be wrong, late or missing. Never follow the app into an unsafe, illegal or impractical maneuver.
- Spoken reminders can distract you and can be overheard. Set their volume and frequency for your situation, or turn them off.
- Where your employer’s rules about phones at work are stricter than these terms, follow your employer’s rules.
You alone are responsible for how you drive and for using the app safely and lawfully while driving, riding or walking. To the fullest extent permitted by law, Function Desk LLC is not liable for any accident, injury, damage, fine or other loss that results from looking at or interacting with your phone while a vehicle is moving.
7. Your data
Your routes and the information you enter belong to you. They stay on your phone unless you share or export them, and we claim no rights to them. Our service receives only what it needs to answer your requests, as the Privacy Policy describes.
Keep a verified backup, and its password, before removing the app or changing phones. We cannot recover data on your phone or a backup’s password. Delete my data, in the app, removes the records our service holds about your phone; it does not recall files you shared, or records kept by the app stores or other providers.
Privacy Policy →8. CarrierCaddy Plus and codes
CarrierCaddy is free to use. Free address lookups come from an allowance shared by everyone on the free plan, released a day at a time, so a day’s share can run out. CarrierCaddy Plus is an optional paid subscription that adds features, such as improved navigation and route display, and a lookup allowance of your own. What Plus includes may change as the app develops. The app shows what Plus includes, and what stays free, before you buy.
- Plus is sold through the App Store or Google Play and billed to your store account. The store shows the price and the billing period before you confirm.
- A subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Manage or cancel it in your App Store or Google Play subscription settings. Deleting or uninstalling the app does not cancel it.
- Refunds for store purchases are handled by Apple or Google under their own policies. We cannot issue them.
- Plus belongs to the anonymous identity on your phone, not to an account. On a new install or a replacement phone signed in to the same store account, use “Restore purchases” in the app.
- We may give out promotional codes for a period of Plus. With a code, Plus features work but lookups come from the shared allowance. A code works once, cannot be exchanged for money, and has no value outside the app. We may refuse or withdraw a code that was sold, published or obtained improperly.
- We may change what Plus includes or its price. A price change takes effect only as the store allows, after the store’s notice to you.
- When Plus or a code ends, the app returns to the free features. Your routes and other data on the phone are not deleted.
Nothing in these terms limits rights you have under the store’s terms or consumer law.
9. License and ownership
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, under these terms. The app, the service, the website and the CarrierCaddy name and logo belong to Function Desk LLC. You may not resell, redistribute, copy or reverse engineer the app, except where the law expressly allows it.
If you send us feedback or suggestions, we may use them without any obligation to you.
10. No warranty
The app and the service are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that they will be uninterrupted or error-free, or that their location, map, address-matching, run-planning, reminder or text-recognition features will be accurate in any given case.
11. Limitation of liability
To the fullest extent permitted by law, Function Desk LLC is not liable for any indirect, incidental, special or consequential damages, or for any loss arising from misdelivery, missed delivery, disciplinary action, lost time, lost or corrupted data, or use of the app while driving, arising out of your use of the app. Our total liability for any claim is limited to the greater of the amount you paid for CarrierCaddy Plus in the twelve months before the claim, or US$50.
Some jurisdictions do not allow these exclusions; where that is so, they apply to the extent permitted. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law.
12. Indemnity
You agree to defend and indemnify Function Desk LLC against claims, losses and costs, including reasonable legal fees, arising from your breach of these terms, your violation of law or of your employer’s policies, or information you enter or share, except to the extent they are caused by us.
13. Google Maps and other services
CarrierCaddy includes Google Maps features and content: the map in the app, address lookups that the US Census Bureau cannot answer, finding the address for a position, and road paths. Your use of Google Maps features and content is subject to the current Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
Google Maps/Google Earth Additional Terms of Service (opens in a new tab)https://maps.google.com/help/terms_maps/
Google Privacy Policy (opens in a new tab)https://policies.google.com/privacy
Address lookups try the US Census Bureau’s public geocoder first. Subscriptions go through the App Store or Google Play and RevenueCat, the subscription service we use. Each provider’s terms and privacy policy govern what it does, and we are not responsible for its availability or accuracy. Lookups are metered; the free allowance and the Plus allowance are stated in the app.
14. App Store and Google Play
If you got the app from Apple’s App Store, these terms are between you and Function Desk LLC, not Apple, and your use of the app must follow the App Store’s Usage Rules. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the app. We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to conform to a legal or regulatory requirement, consumer protection claims, and claims that it infringes someone’s intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
If you got the app from Google Play, Google Play’s terms also apply to your download and to purchases made through it.
15. Ending this agreement
You may stop using CarrierCaddy at any time by uninstalling it; use Delete my data first if you want our service’s records removed. We may suspend or end your access to the service if you break these terms, and we may stop offering CarrierCaddy; the data on your phone stays where it is. The sections on driving, your data, the license, warranty, liability, indemnity and disputes continue after this agreement ends.
16. Changes to these terms
We may update these terms, for example when the app or the law changes. We will post the new version here with its date and, for a material change, tell you in the app or on this site before it takes effect. If you keep using CarrierCaddy after a change takes effect, you accept the new terms.
17. Disputes and governing law
If you have a concern, please contact us first at support@carriercaddy.com; we will try to resolve it within 30 days.
These terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be decided by the state or federal courts located in Marion County, Florida, and you and we consent to their jurisdiction. Either of us may instead bring an eligible claim in small claims court.
18. General
These terms and the Privacy Policy are the whole agreement between you and us about CarrierCaddy. If a court finds part of them unenforceable, the rest stays in effect. Not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them to a successor to CarrierCaddy.
